For Digital Marketing and Technology Development

We offer a variety of services, which may include, but are not limited to:

Scope of Work:

The specific services provided will be detailed in a separate Service Agreement outlining the project goals, deliverables, and timelines.

Client Responsibilities:

  • You agree to provide us with all necessary information and materials in a timely manner.
  • You are responsible for the accuracy and legality of all content provided.
  • You will cooperate with us throughout the project and provide feedback as needed.
  • You will comply with all applicable laws and regulations related to your marketing activities.

Our Responsibilities:

  • We will perform the services outlined in the Service Agreement with a high degree of skill and professionalism.
  • We will keep you informed of the progress of your campaigns and provide regular reports.
  • We will use our best efforts to achieve the agreed-upon goals, but we cannot guarantee specific results.

Term and Termination:

The term of this agreement will be as specified in the Service Agreement. Either party may terminate the agreement with written notice for cause.

Payment:

Payment terms will be outlined in the Service Agreement. You are responsible for timely payment for all services rendered.

Confidentiality:

We will maintain the confidentiality of all your sensitive information. You agree to keep our confidential information confidential as well.


For Human Resource

Job seekers

  • Fees: Job seekers are responsible for any third-party fees that may be required to obtain employment, such as job assistance including resume writing, skill enhancement training, background checks, drug tests, or certifications.
  • Agreement: By using the Benda Infotech’s services, job seekers agrees to the terms and conditions set forth in any contracts or agreements provided by the agency.

Employers

  • Fees: Employers will be charged a fee by the Benda Infotech, for any job placements made through the agency, which will be based on the type of placement and the agreed-upon fee structure.
  • Payment Terms: Employers agree to pay the placement fee within a specified timeframe after the candidate is hired.
  • Cancellation: Employers may be required to pay a cancellation fee if they withdraw a job offer or terminate an employee within a specified timeframe after the placement is made.
  • Agreement: By using our services, employers agree to the terms and conditions set forth in any contracts or agreements provided by the agency.

Confidentiality and Non-Disclosure Terms and Conditions

  • Confidential Information: The company, and all parties involved acknowledge that during a project, confidential and proprietary information may be shared. This includes, but is not limited to, trade secrets, business plans, financial data, customer information, and other sensitive information.
  • Obligation of Confidentiality: All parties, including the company, job seekers, and employers, agree to maintain strict confidentiality regarding any confidential information shared during the recruitment process. This obligation remains in effect during and after the termination of the recruitment relationship.
  • Non-Disclosure: All parties agree not to disclose, divulge, or share any confidential information obtained during the recruitment process without the express written consent of the disclosing party, unless required by law or as part of the legitimate recruitment process.
  • Authorized Use: Confidential information received by job seekers should only be used for the purpose of evaluating and applying for the specific job opportunity. Job seekers shall not use or disclose the confidential information for any other purpose or benefit, including competing with the employer or the company.
  • Return or Destruction of Information: Upon request or at the end of the recruitment process, all parties shall promptly return or destroy any confidential information received, including copies, notes, or other materials containing such information, unless otherwise agreed upon in writing.
  • Exceptions: The obligations of confidentiality and non-disclosure shall not apply to information that: (a) is already in the public domain at the time of disclosure; (b) becomes publicly available through no fault of the receiving party; (c) was already lawfully in the possession of the receiving party prior to disclosure; (d) is independently developed by the receiving party without reference to the disclosed confidential information; or (e) is required to be disclosed by law, regulation, or court order.

Intellectual Property:

We retain ownership of all intellectual property rights developed by us during the course of providing services. You retain ownership of your intellectual property used in the campaign.

Limitation of Liability:

We will not be held liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services.

Entire Agreement:

This page constitutes the entire agreement between the parties and supersedes all prior or contemporaneous communications or agreements.

Changes to Terms:

We may revise these Terms of Use at any time by posting the revised terms on our website. Your continued use of our services following the posting of revised Terms of Use constitutes your agreement to the revised terms.
